One thing I really appreciate about the Nevada Independent (and I don't like Ralston's axe-to-grind mentality generally), is that they always name lawyers, law firms, and post a copy of the relevant document. Genius. It doesn't take any more effort to do these simple things, and it makes the story richer. If only the RJ would see the light. I hate when I get a news story about some damning letter, and then only get 2 or 3 sentences from the letter in the lead paragraph. Well done, Independent!

The author's writing style is strong in that he makes his point but with a slight literary feel. It's rare for me to actually enjoy reading a legal letter but I did here.

Echoing 10:52, same goes for Court opinions, don't like reading a story and then having to look it up.

The repetitive use of "sad" on the first page is distracting. I didn't know if I was reading a series of Trump tweets or a legal response letter. Sad!

I skimmed the rest and it seemed fine, but the sadness of the first page just made me think I was reading a diatribe written by a political hack who reads too much Drudge Report.

But Torchinsky is not a Nevada attorney, so he might be okay as a Deputy AG, but not as the AG himself. Speaking of which, isn't sending a letter threatening litigation an act which constitutes the practice of law? Is a Nevada license required? Genuinely curious.

But practically speaking, it doesn't go that way. If you litigate, you receive demand letters and other types of letters from out of state attorneys on a daily basis. I usually ask them to retain Nevada counsel (simply because our bar is smaller and more collegial than California or Texas), but I've never seen anybody disciplined for it.

That out-of-state firm doesn't even list defamation law as an area of practice. They are all members of the Federalist Society and all they do is political consultation.

Not directly related to a current legal topic(although there are legal implications) there is a feature story in the paper today with the headline bellowing how Tom Cruise repeatedly risks his life in the Mission Impossible movie series.

It features a photos of him hanging from the blades of a helicopter in high flight. The seemingly hopelessly naïve and star-struck reporter marvels how it is miraculous Cruise is still alive since he seemingly cheats certain death several times each movie by performing the most seemingly life-defying dangerous stunts, while using no safety back-up measures, supposedly never using stunt doubles, supposedly never agreeing to instead rely on computer technology to create the scene convincingly without the need to endanger the star actor.

My response to all this is how can anyone be stupid enough to report on, or to believe such pap?

I mentioned that there are legal/liability implications and they are many. The article would have us believe that this star, who earns like 30 million a picture and whose continued health throughout production will make or break the picture at the box office, is constantly put in real peril, is constantly endangered, without apparently anyone insisting that him and his attorneys sign any sort of releases, and that this is all fine by everyone, even though with technology the scenes can be electronically created in an equally convincing fashion without constantly endangering the star. Also, since the producers secure insurance on any actor they are paying multiple millions to, no insurance company would ever under-write such pure, unadulterated idiocy.

And, in fact, we have been hearing about all this garbage since the Mission Impossible series started some years ago. When he was being interviewed by kiss ass members of the entertainment press who would seem astonished by all the supposed risks he took, people watching the reports invariably would say "yeah, right, like they(the film makers) are actually going to endanger him."

So, then why is the entertainment press, as well as the supposedly legitimate news press, continuing to report on such idiocy? And Cruise is just an example. There are constantly unquestioned reports of actors boasting they did their own dangerous stunts.

Now I recognize that some stars of the past, like Steve McQueen with his motorcycle, would perform some of their own stunts on a limited basis, but we are being asked to believe that Tom Cruise and others constantly hang from helicopters in high flight, dive off high cliffs with no parachute into deep waters, hang on the roof of speeding cars going 120 m.p.h., get constantly shot at with life rounds when escaping from villains etc.

And again, I have no ax to grind with Cruise but am using him as the most obvious, and expensive, example. Action stars are constantly seeking to reinforce their machismo by boasting in interviews of the risks they took, performing all their own dangerous stunts, etc.

It was a legitimate entertainment news/feature story, and provoked thought and interest, as demonstrated by 1:29's comments here. What the article fails to mention, however, is the fact that Scientology is the reason why Cruise is able to do all of that. South Park will explain it though.

What a surprise. Wolfson doesn't like the odds at preliminary hearing for a cop who killed a black man and bragged about it so he takes the case to a Grand Jury. He hires an expert who has testified hundreds of times and never has found excessive force and the Grand Jury doesn't indict. Pathetic.

I love how a politician gets in a jam and suddenly he on television, his wife by his side, attesting to the fact that he is truly a good person. Really, the Aaron Ford arrests sound pretty lame, but he maintains such an arrogant persona that it is funny to think he stole a tire from repair shop.

Stole a tire. Broke into a girlfriend's apartment. Stole money out of my wallet as a State Senator while not paying his own taxes. Yeah they are little things. And I truly believe in second chances, but yes second chances for people who are not so smug that they do not offer you the same courtesies and rights.

I could not care any less about what someone did in college (unless violent or molestation as I have come to believe those are personality traits are unlikely to change), but I respect others' rights to hold him to a higher standard. People can change and learn.

The attention to Ford's involvement with police more than 20 years ago in the context of an election is racist. He's lucky that he didn't get shot. There are so many lawyers I know who have much worse in their past & present. This is Las Vegas where everyone gets a 2nd chance. He's made the most of his. Considering how far he's come since then I'm MORE likely to vote for him. I may even make a contribution to his campaign.

I really don't get this "more likely to vote for the guy that has come a long way" sentiment. Wouldn't you be more impressed by the guy that didn't need to come a long way because he didn't make terrible decisions to begin with? I can't even name Ford's opponent, and I'm always willing to forgive and see the best in people, but without knowing anything else, the opponent is 2 steps ahead for me.

This is the 2nd time I will ask, what does race have to do with anything? So he got in a bit of trouble as a young man, lotsa of us did. If you put yourself up for public office you need to expect scrutiny, especially with Citizen Kane controlling the only newspaper…..

Since no one else has mentioned it – hell yes to the dashcam. There are plenty of people out there who have no problem lying out their ass to your insurance company. A dash cam provides the perfect bitch-slap.
