Doubtful. A mental impression of a prosecutor that there isn't enough evidence to bring charges is not relevant exculpatory (Brady) or impeachment (Giglio) evidence, and no court would even let that in. Although it looks good and makes headlines, it won't actually factor into the ongoing criminal case.
What a fucking idiot…….This "principle" just cost you a year of income. Don't thing the NSB or the NSC isnt going to slow walk your app for reinstatement.
I just read the opinion (thx for citation) – I'm being only partially sarcastic when I say that, based on my observations between the NSB writeups of infractions and reality (yes, I was in a position to know, but no longer), the attorney probably forgot to show up to a traffic ticket hearing. It's like the telephone game between attorney-NSB-NSC – it never ends up being real (at least when I was there)
He was and is, but another attorney was blamed for his posts by their opposing counsel in the case to make them look bad and to try to influence the case.
