Curious as to how many people have been arrested, charged with, and convicted of, these same charges in Clark County? I'm guessing none, even though it is rampant here.

UPL has been prosecuted in Clark County (see Charles Radosevich– who really got in trouble for forging Judge Gonzalez's name) but it is EXTREMELY rare. While the SBN claims to want to go after notarios and others, it does nothing. The CCDA does even less to prosecute. The problem is that if you don't claim to be an attorney, it is a difficult crime to prosecute just on the basis that what they are doing SHOULD be done by an attorney.

@ LawyerBird- The State Bar has turned into a full employment division for underwhelming attorneys. There is maybe one lawyer there now that I would ever want on my side in Court (and no it is not Stan any longer).

11:54 here. I am a notary. Are you scared you will lose clients to a non-lawyer. UPL is not that big of a deal. It really only hurts the people who hire the notaries or paralegals.

What kind of practice does someone have that they don't have $63 in their trust account? I handle civil litigation, real estate disputes, and some other miscellaneous matters and mine floats from $45k to $70k every few months, but never less than $40k in the past 18 months (and we're only a two attorney firm.)

I don't know Border. Never heard her name before and had to read the article the other day to even find she was an attorney. She was responsible for the death of a person in an accident. She is paying a HUGE price right now in the criminal justice system for something that in no manner affects her fitness to practice law. Was she convicted of a felony? Because unless and until she is convicted of a "serious crime", SBN will do nothing and let the criminal justice system run its course. And frankly I am fine with that.

You touch your Trust Account (ever for any personal reason), and the State Bar should rain locusts down on you.

Maybe because it wasn't your first rodeo, 7:23? The Supreme Court dismisses 1st-time misdemeanor DUI discipline proceedings as a matter of course. It's always the same Order: "Such and such self-reported the conviction to the State Bar (You did do that, right?). Because the crime is not one of those specifically enumerated in SCR 111(6) as a 'serious' crime, temporary suspension and referral to the disciplinary board are discretionary with this court. SCR 111(9)"
"The seriousness of drinking and driving can not be minimized, however, first offense driving under the influence is not the type of offense for which professional discipline is typically imposed."

So, what did you do that made the Supremes decide to spank you?

5:39 here– so let me clarify. I am not saying discipline is not warranted. My question/point was related to the procedural posture of her case because that may answer the question as to why the SBN/NSC has not taken action. Rule 111 says that the Bar acts against attorneys convicted of crimes; has she pled guilty and/or been convicted?   Upon being advised that an attorney subject to the disciplinary jurisdiction of the supreme court has been convicted of a crime, that is what triggers bar counsel to file a petition with the supreme court. Only upon the filing with the supreme court of a petition with a certified copy of proof of the conviction, demonstrating that an attorney has been convicted of a serious crime does the court enter an order suspending the attorney. If she is convicted of a non-felony (see Stubbs) that is not deceit, extortion, bribery, etc., she is not going to be summarily suspended pending discipline unless the conduct adversely reflects on the attorney’s fitness to practice law. No one here said she should not ultimately be disciplined, The question was merely one of where she is in the process which might explain where the State Bar and Supreme Court are in their respective processes.

My understanding with Marisa Border was that it was an unfortunate accident. She was passing/speeding and the biker turned in front of her. The conviction is presumptive on the liability so she is still facing the music on the liability. It was just negligence plain and simple resulting in a deadly accident. It is no different than blowing a stop sign and or a light. There is a big difference between someone who is driving under the influence and going against the traffic resulting in a fatality. But for the fact that the biker made a turn at that precise moment the accident would not have occurred. She has plead guilty to a misdemeanor.

10:04, yes, it is an "accident" when you drive recklessly, speeding and enter in a no pass lane, with two small kids in the vehicle, and you decide that you are more important than others, and kill somebody. You also risk the lives of the other motorcyclists on the road. Blame it on the man she killed, douche.
