We need a lawyer’s union. I mean really: who advocates for the best interests of the average practitioner? Certainly not the SBN or the NSC. Maybe we could affiliate with the AFL-CIO or something.
If u are serious email me at tempdlm@yahoo.com, use an alias I don't care, and ill chat with u as I would work toward that goal, lux in nevada, near retirement so no fear of bar, thanks
Where did Andrew Craner go? Paola Armeni?
2:30 and 11:37 on December 20: Please feel free to contact me at nvesq@cox.net regarding any concerns that you may have regarding the SBN. Have a great holiday!
Please trust no one in this profession. Do not trust everything posted on here either. One of the few people I do trust was trashed on here by trolls. Just be careful.
Andrew Craner (nvesq@cox.net): I like you. No offense but there is no evidence that anything has changed or that any steps are being taken to change anything.
When you say that people should contact you "regarding any concerns that you may have regarding the SBN", please tell me you remember all of the concerns that were discussed before you ran. We are pissed. And nothing is appearing to change. I don't want to write to you privately about what is changing. I want you to come out and tell us as our elected Governor what is changing. No offense– the lack of transparency as to what the (bleep) is going on at the BoG is why I voted for you because I thought that was going to change.
Has anyone done the free Lexis Nexis CLEs? I have completed my CLEs for the year however the 3.0 General credits I should have from Lexis have not yet shown up on my transcript and I am worried they won't show up by 12/31.
I had this issue last year but it was easily fixed. Print out proof of completion and give the bar a call to make sure you get credit.
Thanks.
I need one hour of ethics and one hour of don’t drink too effing much. Are there still good options through SBN to get this?
There is an article in the October Nevada lawyer called to Report or Not To Report for the AAMH credit.
Sure. Along with the $45 eff you tax to the State Bar for "processing." There's a substance abuse CLE audio CD in the Law Library, allowing you to get away with listening, reporting, and paying only $5.
LexVid.com offers a free 1.0 hour of anything for new users. They have a few substance abuse CLEs.
Thanks for the tip on the article. $45.00 is pure extortion though.
$45 to have Vanessa Dalton (the receptionist) receive your fax. It is ridiculous but hey! Kim Farmer's nice office is not going to pay for itself.
Ed. Miley. Bruce. Gale.
Why people do things they know damn well will turn into a public spectacle is something that I will just never be able to understand. Get your divorce and move on already.
They probably behave that way because when people lose their temper and explode they don't stop to think "I'm an elected official, so this will be reported by the media. It's not like I'm merely a convenience store clerk, in which case it would be of no public interest."
But if thy had better impulse control, and did stop for a moment to think before they reacted, they would realize it will be covered by the media.
18-year-olds can be exasperating beyond measure, and some of them can bring anyone to the brink. I'm not,of course, excusing her striking him if that in fact occurred. I am merely observing that many 18-year-olds would try the patience of a saint.
It had made it to the Daily Mail and The New York Post:
A judge in Nevada was arrested by Las Vegas police on a domestic violence charge after an incident involving her 18-year-old son, an attorney for the judge’s estranged husband told police.
Clark County District Judge Stefany Miley was arrested around 11 p.m. Saturday after an attorney for her husband, Edward Miley, called police late Saturday to report an incident that allegedly turned physical between the judge and the couple’s teenage son, according to the Las Vegas Review-Journal.
The Mileys are in the process of getting a divorce. Edward Miley, who is a family law and criminal defense attorney, forwarded a message from his son to Bruce Gale, one of the attorneys representing him in his own divorce.
“Call me now,” the teen wrote in the message forwarded to Gale. “I need help. Mom punched me in the mouth and hit me in the head while I was driving. I [am] bleeding and need you to pick me up. She started screaming around the neighbors and tried falling on me to make it look like I was hurting her.”
Gale told the newspaper he contacted police after speaking with Edward Miley and reviewing the state’s rules of conduct for attorneys. Stefany Miley, a native of Texas first elected to Nevada’s Family Court in 2004, is now facing one count of battery domestic violence under her maiden name of Stefany Tewell, according to court records cited by the newspaper.
Details of the judge’s arrest were not immediately available and police in Las Vegas did not return a message seeking comment early Thursday.
An attorney representing the judge said he had not yet seen the police report regarding the incident.
“We look forward to representing Judge Miley, who intends on vigorously defending herself against these mere allegations,” David Chesnoff told the Review-Journal.
Stefany Miley is scheduled to appear before a judge on Jan. 22. Edward Miley filed to dissolve their marriage earlier this year, citing “catastrophic health issues” and also requesting spousal support.
Attorneys for Edward Miley said in his filing that while he “loves his wife Stefany very much,” the couple’s incompatibility is so vast that no chance of reconciliation exists.
The document also claims that Miley has “conducted herself in such a manner, and taken certain actions, that are improper and inappropriate to the harm and detriment of Edward,” according to the Review-Journal.
The judge, meanwhile, acknowledged in a separate filing that she and Miley are “incompatible in marriage” but denied the “false and defamatory” allegations.
The incident marks at least the second time that the Mileys have been involved in a domestic violence incident. In October 2009, Edward Miley was arrested on a domestic battery charge after an argument at the couple’s home during which he allegedly choked the judge and the couple’s dog, KTNV reports.
The judge was later granted a temporary protective order against Edward Miley and later filed for divorce. The couple then briefly reconciled but is now in the midst of a divorce for the second time, according to the station.
Stefany Miley, according to a 2014 website for her re-election bid, was raised in Austin, Texas, before graduating from Texas A&M University with a degree in journalism and marketing. She was first elected to Family Court in 2004. Four years later, she was elected to District Court, where she presides over civil and criminal cases.
A court spokesperson did not respond to a request for comment, KSNV reports.
Her attorney said that they look forward to defend her against these "mere allegations." Very poor choice of words as those words indicate the allegations may or may not eventually turn out to be true, but that so far they have not been tested in court.
Attorney should have said "unfounded allegations", or "totally false allegations",or something similar that indicates when the allegations are finally vetted in a court of law they will be found to be baseless.
Interesting remark because a friend of mine, who is not involved with the law, pointed out that in the article her attorney made only a half-hearted response, which made it seem like the attorney does not yet know, or have a view point, on whether any of this is true or false. He was quite surprised the attorney did not aggressively deny the validity of the charges.
Are you really questioning Chesnoff in his responses and ability to kick the snot out of the prosecutors on this one? Mere allegations means that he is asserting that there is no evidence and that even the alleged victim did not call the cops.
CLE–The Clark County Bar offers CLEs in DVD and Downloadable format at very reasonable prices. The CLEs are open to members and non members of the CCBA. The CLEs are generally very good and timely. They are also cost effective.

So I got a lesson in how the State Bar gets you. I called the Ethics Hotline. It went to voicemail. I did not leave a voicemail. I did not leave my name or my issue. I did not want to leave any trace as to what my identity was because obviously I wanted my question to be confidential and not tied to me. I got a call back from one of the OBCs who indicated that they were calling my back about my "ethics issue." I asked how would they know that I confidentially called and they said nothing is confidential because they have Caller ID and track exactly who called them.
Ethics Hotline: (800) 254-2797
The State Bar of Nevada's Office of Bar Counsel provides attorneys with assistance and education to help them practice ethically and competently. The Ethics Hotline can make navigating the Rules of Professional Conduct easier. State bar attorneys are available to answer ethics questions during business hours, offering callers informal opinions based on their comprehensive knowledge of the Rules of Professional Conduct. Calls typically last fewer than 10 minutes.
Even if you think your question is embarrassingly simple, don't hesitate to call the Ethics Hotline. When it comes to legal ethics, it is always better to be safe than sorry. All hotline calls are confidential."
Guess it’s burner phones from here on out.
Wanted: Coin-operated payphone for clandestine calls to the "confidential" ethics hotline. Haha!
Black's Law Dictionary defines deceit as: "A fraudulent and deceptive misrepresentation, artifice, or device, used by one or more persons to deceive and trick another, who is ignorant of the true facts, to the prejudice and damage of the party imposed upon."
It has been a couple years since I called the Ethics Hotline, but every time I ever called, they took my info before talking to me. Like 2:06 said, not anonymous (but hopefully confidential).
I've called I think twice. I frankly don't remember whether they took my info or not. But I do remember they were completely useless and refused to give any sort of direction at all. So now instead of calling, I try to talk to as many different lawyers (that I know well, trust, and think have high ethical standards) as I can to get other perspectives, or see if anyone else has already dealt with the same issue.
Phil Patee states one thing in lecture and another thing on discipline.
Confidential does not mean anonymous.
So then I guess that begs the question, confidentiality as to whom?
Absolutely correct. See definition of "deceit" above.
