The City of Henderson hired Bailey Kennedy as outside counsel in a battle against the RJ regarding access to documents. Since the RJ is the one writing the story, they’re sure to point out that senior partners at Bailey Kennedy bill at $495 hour andJ that Henderson has 12 civil attorneys and a City Attorney who receives more than $300,000 a year in salary and benefits. Someone has alerted us to an older article with ties to current events in Nevada. A serial-ADA suer (read: ADA troll) has moved into Nevada and is connected to hundreds of suits in Arizona, Colorado, and New Mexico. Here, the Plaintiff behind the suits is Kevin Zimmerman and he is represented by attorney Whitney Wilcher. [ABC15-Arizona]
Yes. The city has also hired attorneys from Snell and Holland and Hart recently, but I don't think the City is sending any work their way.

Probably not a coincidence, but not shady either. Naturally he's going to hire outside counsel who he's familiar with.

These powerhouse attorneys will make zero difference when it comes to the public records law. All records are basically public subject to some very fine exceptions and exclusions. The Cities and government entities can't win most arguments. Nevada has a very broad public records law. It is much more open than FOIA. The current makeup of the Supreme Court and the District Courts generally means the Cities and government entities lose. End of story. The Legislature will never change the law. By the way, the Legislature is not subject to public records.
1:15 PM-In public records disputes, the prevailing party can recover fees and costs. This is one of the reasons the stakes are high. Public records law cases are generally a loser for the City and government entities. Don't agree with some of the positions taken by the newspaper. The big ticket item is where the government agency is required or undertakes to create the records from raw data. Are those costs recoverable, what is reasonable, and do they have to extract the raw data. It sort of reminds me of E-discovery. Everyone thinks there is a record for everything and there really is not.
Don Campbell does not get work from RJ anymore since Adelson bought it.

The firm I work for was solicited by an ADA troll a few years ago. I have no idea whether it was the same group or not. They promised us a lot of easy money. We instinctively turned them away. It's basically a shake down of small businesses.
I am only surprised that Whitney filed 30 Complaints in a few days. Whitney is one of the laziest, most worthless pantloads I have ever encountered. Quite clearly Whitney must have been his e-file password to this Zimmerman guy or has someone filing for him because Whitney could not sign his name 30 times in a few days.
These BS cases are the reason why people hate attorneys. The guy doesn't intend to use all of the businesses he visits – he goes specifically to create a lawsuit.
"These BS cases are the reason why people hate attorneys." This is exactly right. When a lay person only hears about cases like this or thinks McDonalds had to pay $1M for spilled coffee, it only reinforces the popular notion that our entire judiciary is a shake-down for lawyers. The Bar and the bench should do more to slap around litigants and attorneys who file these suits in order to protect the integrity of the judiciary and profession.
I do believe "he" is actually a she. Think Whitney Houston.

More information on Whitney Wilcher please. I have seen dozens of filings by her in the last couple of days and am trying to figure out what is going on.
I would link to Whitney's law firm but since the SBN says he is working out of his house, I would have to give you his home address. But yes, Duderino is about right.
Whitney is 100% lazy ass man. You could trust LinkedIn or you could trust the people who have been dragging his ass through CD Cases for 17 years as he munched snacks and did very little else.

I wish newspapers would do a better job about identifying who is representing the parties in cases. This speedvegas one has multiple attorneys involved and i see a few in the pictures and not all are listed in the article.
You have to pay to play. No publicist? Not hot? Don't expect the "journalists" at the RJ to name names.

Not to take anything away from the kids trapped in the abuse and neglect system, nor the generous people that volunteer to stand up for them as CASA's, but, where is the money for the pinwheels coming from?
Bailey Kennedy's senior partners only bill at $495? Not exactly top of the market. Sounds like Henderson made a conservative choice.
Worth every penny. Top firm.
John and Dennis bill at FAR higher than $495 an hour normally. This was a bid rate which does not reflect their standard rates.
Coincidence that BK is hired after the City of Henderson hires an ex-BK attorney as a city attorney?
Yes. The city has also hired attorneys from Snell and Holland and Hart recently, but I don't think the City is sending any work their way.

Has the RJ disclosed how much it paid Don Campbell or any of its high priced attorneys? Guess that is not as relevant.

I'm kinda shocked that Whit Wilcher fell for it…
Really? You're shocked? Why?
Wilcher has filed probably 30 cases in fed ct here over the last few days for Zimmerman.

ADA is an unconstitutional evil that has made finding a good shitter impossible. Impossible. Evil. Just evil.
Fake a limp; poop where you wish.

Whitney is a dude. A lazy dude. But a dude.
What, like His Dudeness, Duder, or El Duderino?
I would link to Whitney's law firm but since the SBN says he is working out of his house, I would have to give you his home address. But yes, Duderino is about right.
nah – he's just a fella these days. Not a Dude and not abiding….
Nope. Appears female, per linkedIn… Probably would prefer you think of her as a him though- would likely want to remain as anonymous as possible.
Whitney Welcher is a man.
Speaking as someone who worked in the same office with his lazy ass, he's a dude.
Having sat across from him at many depositions, he is a dude, though at times may whine like a dudette

We know reporters read this blog. Pro Tip – a little attribution of attorneys would take no extra work and would gain you a loyal lawyer following
AND please identify the judges in newspaper & TV reporting. Since they are elected by popular vote….inquiring minds want to know!

They offered their service pro bono.
