The fact is that the Chapter 40 scheme, as it has existed during the past 20 or so years, is equally extreme when compared to what the current bill will now do to the process. As with most things, sanity lies somewhere in the middle.
Low information voters who believe anything they are told, like…"What does it matter NOW?!" "I did not have sex with that lady…Ms. Lewinski!" "It depends on what the meaning of is, is…" "Vote for President Obama or the Republicans will take away your right to vote!" "I was raped by a well known outspoken conservative that had a college produced radio show." You mean like those kind of low information voters?
What keeps me up at night about the passage of AB125, all those constuction defect lawyers will now be chasing my general commerical litigation work, and will be able offer to do the work at low rates because they are already so used to those rates.
Only the lower level construction defect lawyers will find themselves without work. And the great majority of those who get forced out of that arena are incapable of handling general commercial litigation. We may; however, see a small spike in low-level personal injury and traffic ticket lawyers.
If your clients are willing to give their important legal work to woefully unprepared former construction defect defense lawyers in order to save a few bucks, then those clients deserve what they get.
Does anyone honestly believe that the cookie-eaters are going to magically turn themselves into real lawyers?

Relatively recent (non-UNLV) grad here. Several of my classmates went straight into CD work and have done nothing else. They are the most at risk in all this, IMO. At one point, I had an opportunity to switch over to CD and make more money. Really glad I stuck to real litigation.

No, they'll do what all desperate attorneys do and decide that they're crim and bankruptcy guys and try to charge the lowest rates they possibly can for taking the worst deals the DA's can give them and completely screw up a BK. It's a tried and true formula, we see it all the time.

I still don't get the hatred that some of the people who post here have for CD defense attorneys. In general, it seems to be not the best way to make a living in that is low money and you are essentially a glorified insurance adjuster in a lot of cases and are essentially sleepwalking. It's not as though most people really chose that line of work anyway. I understand feeling badly for people who are stuck in it, but certainly don't hate them for what they have to do to make a living.
I did CD for 8 months. I hated it, and developed a huge dislike for CD attorneys. You've never seen more idiots sit around and talk about how they are the greatest attorneys on the planet, yet they can't write a simple brief, take a deposition, or do anything that a paralegal couldn't do. That's why we hate the CD bar…especially the Helmasaurus.
I think it is sexy when Helm licks his lips after eating a powdered donut!

CD is not going anywhere. The only people who get screwed are the homeowners. The lawyers will not just take their percentage out of the recovery and the homeowner will not have enough to fix their house. Great job Ira Hansen and Senator Roberson. Screw more people over.
