I am on call 24/7/365. The price of being a member of the laptop class. I admire the attorneys who can just turn off the phone and laptop.
The article raises some good points about how our duties as a lawyer never cease, but obviously those can be taken care of by things like making sure your secretary is copied on all ecf filings, etc. I think in an ideal world you should be able to both put the phone down and shut the laptop while you’re “out of office.”
I agree, I thought the partner email would say that you’re supposed to do real work every day, which would be absurd. But checking your email every couple of days is, unfortunately, necessary in this job, even if other people will be cc’d on most filings. You just can’t assume a secretary or a lawyer not primarily responsible for a matter will understand the importance of certain emails, and I’ve definitely had opposing counsel fail to cc anyone else on an email to me even when I had an out-of-office up.
