2017 Legislative Session

The 2017 Nevada Legislature kicked off its 120-day session yesterday. There are a lot of bills up for consideration. Anyone have any bold predictions about what we will see become law out of this session? Any bills that the legal community in particular should be watching?

Also, on of our readers wants to know how to get into the lobbying business in Carson City. Any pointers?

No chance on either of those passing. Aaron Ford is in control. The insurance lobby had their only chance last session.

Everyone knows that Aaron and his wife couldn't do anything with their JD's and their minority status in a much more diverse and powerful Texas judiciary, and so they appear on the Vegas legal scene and backed with Bob's money and all of a sudden are doing just quite nicely for themselves. No, I'm not a Republican! No, I didn't vote for Trump!
Just calling it how it is!

Agree with 1:08, Ford is just a paid for private professional legislator hiding behind his law degree and his non-equity partner status @ E&P.

Seems to me Bob has it all sewn up. Control of RJC judges, majority leader in State Senate. What area of law does Aaron Ford practice for Eglet & Prince? Certainly, it's not PI as I have never seen him listed as counsel for a Motion, appearance in a hearing etc. I can only guess that his position as partner is one of legislator/personal lobbyist in law bill passage or law bill denial at the state level. Anyone have any legal reference for Ford actually practicing law at Eglet?

Aaron Ford is big on CCSD board issues … mostly advocate for issues that have a threat to teacher's union objectives.

A-16-738799-C is a case where Ford is listed as counsel at Eglet's office. It is a personal injury/construction defect case.

Insurance defense lawyers should rightly love Ford/Bob. Insurance companies should rightly fear Ford/Bob.

If you're an insurance defense lawyer and you don't yet understand that what's good for Bob is good for you, sit and think about it for a moment. Better yet, go have one of the partners explain it to you. And after you understand, don't tell the insurance company people who send work to you.

Newbie question: defendant files ans/cc – does plaintiff file Motion to Dismiss counterclaims before or after her reply to counterclaim? Thank you for any help

You can file that Motion to Dismiss before you file that answer sweetheart.

Look at NRCP 12(b). It lists out defenses that have to be made before filing a pleading. So, the answer depends on the basis for your motion to dismiss. If you do it after you've filed your Reply, then you would need to do a motion for judgment on the pleadings. However, per 12(h)(3), if the court doesn't have subject matter jurisdiction it can dismiss the case at any time.

Did you sleep through Civil Procedure? If someone files a counter/third-party claim, all of the same rules relating to pleadings and Rule 12 motions apply, just as they would apply to P v. D.

Are the rumors true that there will be a bill introduced as to raising the minimum policy limits for auto insurance (liability) from $15,000 to $25,000?

10:21- Full time Nevada Legislature. Nope. You know what they say, "No one is safe while the Legislature is in session" and that was said by Mark Twain about the Nevada Legislature. Our only hope is gridlock otherwise we will get crazy bills like the stadium.

Everything, from the minor and mundane to the grand and complicated, must start as a bill draft request. It'll be around 1300 by the end of session, and that's fairly typical for a legislative session. The number of BDRs that can be requested is generally capped, precisely because o the 120-day limit for regular legislative sessions.

Of the BDRs, usually around 1000 actually get introduced, again fairly typical.

And by the end of the session, 100's more will be filed. Keep it at 120 days every 2 years.

But I'd rather live in both than anywhere else.
